Regulatory & Reportable Conduct 
​
EIS conducts independent investigations under statutory and regulatory frameworks, including the Child Wellbeing and Safety Act 2005 (Vic), the NDIS Incident Management and Reportable Incidents Rules 2018, aged care regulatory requirements, and DFFH's Client Management System (CIMS).
 
We support organisations responding to serious incidents involving children, people with disabilities and aged care residents where matters are subject to regulatory oversight.

Reportable matters may include:

  • Death or serious injury
  • Sexual offences or misconduct 
  • Physical violence 
  • Abuse or neglect
  • Significant emotional or psychological harm
  • Unauthorised restrictive practices

Investigations are independently conducted, evidence-based and aligned with regulatory obligations. Terms of Reference and investigation plans are prepared at the outset. All relevant evidence is gathered and assessed in accordance with proper evidentiary principles. 
 
Procedural fairness is observed throughout. Findings are made on the balance of probabilities, applying the Briginshaw principle where appropriate.

Final reports clearly set out the allegations, evidence, findings and reasoning, and are prepared to withstand regulatory scrutiny and external review.
